In these terms, "we", "us" and "our" mean Array Designs trading as Clever Solutions. "You" and "your" mean the person using our website or placing an order.

2. Agreement to these terms

By accessing our website or placing an order, you agree to these Terms of Service. If you do not agree, do not use our website.

These terms should be read together with our Privacy Policy, Shipping Policy and Refund and Returns Policy, which form part of this agreement.

3. Eligibility

To place an order, you must be at least 18 years of age and legally capable of entering into a binding contract.

4. Products

We make every effort to display our products accurately, including colours, dimensions and materials. Colours may appear differently on different screens.

Product images are illustrative. Cloths, sponges, brushes and other items shown in product photography are not included with your purchase unless expressly stated.

The Clever Caddy is designed for indoor domestic use, mounted to the inside of a clean, dry, flat cabinet door or wall surface. It is not designed for outdoor use, for load bearing, or for mounting to surfaces that are wet, greasy, textured, or unstable.

We reserve the right to modify or discontinue a product at any time.

5. Pricing

All prices are in Australian dollars and include GST.

We reserve the right to change our prices at any time. The price that applies to your order is the price displayed at the time you complete checkout.

We take care to display prices correctly. If a product is listed at an incorrect price due to an error, we reserve the right to cancel the order and refund you in full, whether or not the order has been confirmed. We will contact you before doing so.

6. Orders

When you place an order, you make an offer to purchase. Our order confirmation email acknowledges receipt of your order. A binding contract is formed when we dispatch your order.

We reserve the right to refuse or cancel any order, including where:

• The product is out of stock
• There is an error in the price or product description
• We suspect the order is fraudulent
• We are unable to deliver to your address

If we cancel your order, we will refund you in full.

7. Payment

We accept Visa, Mastercard, American Express, Apple Pay, Google Pay, PayPal and Shop Pay.

Payments are processed by third party providers. We do not store your full card details.

You warrant that you are authorised to use the payment method you provide.

8. Shipping and delivery

Shipping and delivery are covered in our Shipping Policy.

Risk in the goods passes to you on delivery to the address you provide.

9. Returns and refunds

Returns and refunds are covered in our Refund and Returns Policy.

10. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.

11. Correct use of the product

You are responsible for installing and using the Clever Caddy correctly, in accordance with the instructions provided with the product and on our website.

To the extent permitted by law, we are not liable for damage to your property, or for the failure of the product to remain mounted, where:

• The mounting surface was not clean, dry and flat before installation
• The adhesive was not given the recommended curing time before the product was loaded
• The product was mounted to an unsuitable surface
• The product was overloaded beyond its intended use
• The adhesive was reused after removal
• The product was modified

12. Intellectual property

All content on this website, including the Clever Solutions and Array Designs names and logos, product designs, photographs, text, graphics and layout, is owned by us or licensed to us, and is protected by Australian and international intellectual property law.

You may not copy, reproduce, distribute, modify or use any of it for commercial purposes without our prior written permission.

13. Reviews and user content

If you submit a review, photo, comment or other content to us, you grant us a perpetual, royalty free, worldwide licence to use, reproduce and display that content for marketing and promotional purposes.

You warrant that any content you submit is your own, is accurate, and does not infringe anyone else's rights.

We reserve the right to remove any content at our discretion.

14. Third party links

Our website may contain links to third party websites. We do not control those websites and are not responsible for their content, products or privacy practices.

15. Limitation of liability

To the maximum extent permitted by law, and subject to clause 10, our total liability to you arising out of or in connection with your use of our website or the products, whether in contract, tort, statute or otherwise, is limited to the amount you paid for the product giving rise to the claim.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of opportunity, or loss of data.

We aim to keep our website available at all times, but we do not guarantee uninterrupted access. We may suspend, withdraw or restrict access to all or part of our website for business or operational reasons without notice.

We handle your personal information in accordance with our Privacy Policy.

We may update these terms at any time. The current version is always available on this page. The terms that apply to your order are the terms published at the time you placed it.

19. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non exclusive jurisdiction of the courts of New South Wales.
